Introduction

Vivi Money Pty Ltd (“Vivi Money,” “Vivi”, “we,” “our,” or “us”) provides a money
management service that helps customers organise their finances. By accessing
or using Vivi Money, you agree to be bound by these Terms of Service
(“Terms”). If you do not agree to these Terms, you should cease using our
services.


Acceptance of Terms

By creating a Vivi Money account, you acknowledge that you have read,
understood, and agree to be bound by these Terms. These Terms constitute the
entire agreement between you and Vivi Money and govern your use of our
services. We reserve the right to update these Terms at any time, and it is your
responsibility to review them periodically.


Service Overview

Vivi Money provides an AI-powered money management tool to help you
organise your finances, but it does not offer financial, legal, or tax advice. You
should consult with a financial advisor or accountant before making any
significant financial decisions based on the information provided by our
services.


Subscription and Fees

  1. Subscription Plans: Vivi Money offers both free and paid subscription
    plans. By subscribing to a paid plan, you agree to pay the applicable fees
    as described at the time of subscription. All fees are inclusive of GST
    where applicable.

  2. Payment Terms: Subscription fees are billed in advance on a monthly or
    annual basis, depending on your chosen plan. You authorise us to charge
    your nominated payment method for these fees.

  3. Cancellation and Refunds: You may cancel your subscription at any time through your account settings or via the app store. If you cancel your subscription, you will not be entitled to a refund for any unused portion of the subscription period.

  4. Changes to Fees: We reserve the right to modify the subscription fees at any time. Any changes will take effect at the end of your current subscription period.


Privacy and Data Handling

Your privacy is important to us and the handling of your personal information is
governed by our Privacy Policy. The Privacy Policy explains how we collect, use,
store, and protect your personal information, as well as your rights regarding
your data.


By using our services, you agree to the collection and use of information in
accordance with our Privacy Policy. It is your responsibility to ensure that the

storage and access to the data input into Vivi Money complies with the laws
applicable to you.

    to assist you in managing your wealth by providing insights based on your
    financial data, however any information generated should not be
    interpreted as financial, legal or tax advice. The content Vivi Money
    provides is based on your inputs, publicly accessible data and other
    available sources. It is intended for informational purposes only and
    should not be relied upon when making financial or investment decisions.
    We encourage you to seek independent financial advice tailored to your
    circumstances before taking any action.

  2. Service Availability: Vivi Money is provided to you on an “as is” and “as
    available” basis. We do not guarantee that Vivi Money will function
    without interruptions or errors and we do not warrant that the service
    will meet your specific needs. Access to Vivi Money may be subject to
    interruptions and any reliance on the service is at your own risk.

  3. Limitation of Liability: To the fullest extent permitted by law, Vivi
    Money disclaims any liability for damages, losses, or expenses incurred
    directly or indirectly from the use or inability to use our services. This
    includes, but is not limited to, any loss of data, profits, revenue, or
    savings.

  4. Indemnification: You agree to indemnify Vivi Money against any claims,
    losses, or expenses (including legal fees) that arise from your use of our
    service in violation of these Terms. This includes any claims related to the
    misuse of data or any third-party rights infringements.


Intellectual Property

Vivi Money retains all rights, title, and interest in and to the service, including
all intellectual property rights. You may not use Vivi Money’s content or
materials for any commercial purposes without our prior written consent.


Termination

We reserve the right to terminate or suspend your account at our sole
discretion if you violate these Terms or engage in any conduct that we deem
harmful to the service or other users. You may terminate your account at any
time by providing notice to us.


Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any
disputes arising from these Terms or your use of Vivi Money will be subject to
the non-exclusive jurisdiction of the courts of New South Wales.
